There are two key factors that could pull in third parties. One, is serving a minor. Third parties would need to prove that a believable fake ID was presented along with the drunk driver appearing well overage. Two, third parties need to prove that they did not serve a noticeably intoxicated driver. These third parties could include bars, restaurants, clubs, employers, and citizens in their private homes.
